1. TERMS AND CONDITIONS

1.1 These general terms and conditions (the “Terms”) apply when you as a consumer (“you”) place an order via www.davidthornell.com (the “Site”). Agreement is concluded between you and Thornell Orrenvade AB, legal registration number 559401-6908 ("David Thornell"). Detailed contact details and other information about us can be found on the website. The terms and conditions are only applicable to you who are consumers and who place orders via the website.


1.2 In order to order on the website, you must be 18 years of age. Persons under the age of 18 must have a guardian's written permission to order. According to Swedish law, we do not accept credit purchases for people under the age of 18. We reserve the right to refuse or change your order in individual cases (for example, if you intentionally entered incorrect personal data and/or have payment objections).


1.3 David Thornell reserves the right for final sales and any image and writing errors on the website, for example errors in product description or technical specification, incorrect prices and price adjustments (such as changed prices from suppliers or currency changes) or incorrect information regarding whether an item is in stock. David Thonell has the right to correct any such errors and to change or update the information at any time. If an incorrect price has been quoted for an item that you have ordered, David Thornell will of course notify you of this and await your approval of the corrected price before David Thornell will proceed with the order. All image information on the website should be viewed exclusively as illustrations. Such illustrations cannot guarantee the exact appearance of the item.


1.4 Webbplatsen, samt allt innehåll på denna, ägs av David Thornell eller dess licensgivare. Informationen är skyddad genom bland annat immaterialrättsliga och marknadsrättsliga lagar. Detta innebär att varumärken, firmanamn, produktnamn, bilder och grafik, design, layout samt information om varor, tjänster och annat innehåll inte får kopieras eller användas utan skriftligt godkännande från David Thornell.

 

2. AGREEMENT AND ORDERS 

2.1 In order to make a purchase via the website, you must accept the terms. By accepting the terms, you undertake to follow the terms in their entirety, as well as agree that you have read the information about personal data and consented to the use of personal data and cookies in accordance with our Privacy Policy.


2.2 An agreement for purchase is only entered into when David Thornell has confirmed your order and you have received order confirmation from David Thornell by e-mail. David Thornell encourages you to save this order confirmation for any contact with customer service. You can cancel your order until it has been confirmed by David Thornell. If the order is cancelled, David Thornell will refund any payments made by you or your debit or credit card companies in respect of the order.

 

3. CUSTOMER INFORMATION 

3.1 When you register your user account and/or place an order, you will be asked to provide certain personal data. You confirm that the information you fill in is correct and complete and are responsible for incorrectly filled information. Information about David Thornell's processing of personal data can be found in David Thornell's Privacy Policy.


3.2 You undertake to ensure that no one else can use your login details. You must not disclose the username and password to any unauthorized person and must ensure that documents containing information about the username and password are stored in such a way that unauthorized persons cannot gain access to the information. You must immediately notify David Thornell if it is suspected that an unauthorized person has gained access to your password. You are responsible for all purchases made with your login details if such notification has not been made.


3.3 If David Thornell suspects that you are abusing your user account or login details or otherwise breaching the terms, David Thornell has the right to suspend you. David Thornell also has the right to assign you new login credentials.

 

4. PRICES, FEES AND PAYMENTS

4.1 When ordering via the website, the prices stated on the website apply. Prices are stated in Swedish kronor and include VAT. Prices do not include payment and shipping fees, which are listed separately.


4.2 You can pay in the ways specified on the website. David Thornell has the right to charge already in connection with the order, unless invoice payment or another similar payment method has been chosen by you and approved by David Thornell. In case of invoice payment or partial payment, David Thornell or its partners may make a credit report. In such case, you will be informed about this. David Thornell reserves the right not to always offer all payment methods, or to change the payment method if the one you have chosen for some reason does not work at the time of purchase. Please note that any restrictions on payment options are indicated on the website.

 

5. PROMOTIONS AND OFFERS

5.1 David Thornell may from time to time offer promotions on the website which may have more favorable terms than those set out in these terms, e.g. regarding payment or extended right of withdrawal. These preferential terms apply for as long as the promotion is active and for the specific goods specified by David Thornell in connection with the promotion. David Thornell reserves the right to withdraw such promotions at any time. In the event of termination or cancellation of a promotion, these terms and conditions apply without modification. Offers on specific items on the website are valid for a limited time and while stocks last.

 

6. GIFT CARD
 

6.1 Gift cards sold at David Thornell are valid for two (2) years from the date of issue and can be used at the David Thornell webshop. Once the validity period has expired, the card cannot be used as a means of payment, cannot be reactivated and the remaining value cannot be refunded. Your gift card is a document of value that must be kept securely and cannot be exchanged for money. Lost or stolen cards are not replaced.

 

7. DELIVERIES

7.1 Goods that are in stock are normally delivered within the number of working days specified on the website. Unless otherwise specifically agreed (e.g. in connection with the booking of goods that are not in stock), delivery takes place no later than 30 working days from when David Thornell confirms the order in writing through the order confirmation.


7.2 The expected delivery time of the product is shown in the order confirmation, in the checkout and/or on the current product page on the website. Unless otherwise specifically agreed and a delivery takes more than 30 working days and this is not due to you as a customer, you have the right to cancel the purchase.


7.3 If packages are to be redeemed, you must do so within the time specified in the notification. Packages must normally be picked up in person with valid identification and order number. You always receive a notification that shows where and when packages are to be picked up. Notification can take place via e-mail, regular mail and, if you have provided a mobile number, also via phone calls or SMS. If you do not pick up the package, David Thornell has the right to charge you a fee of SEK 250. For home delivery, there needs to be a person available to receive the package.

 

8. RETURNS

8.1 When purchasing goods on the website, according to Swedish law, all customers have 14 days to change their minds. The 14 days start from the day you collect the product. The item must be in the same condition as when you received it. All costs related to the return will be at your own expense. The item must be sent well packaged, in good condition and in the original box. Contact us at mail@davidthornell.com to get the address to return your order.

ATTENTION! We currently do not support returns as the products you order are personalized and made specifically for each order. If you want to place a new order, you are responsible for the costs of the new order.

 

9. WARRANTY AND COMPLAINTS

9.1 Some of David Thornell's goods may be covered by warranty. The warranty for goods only covers original manufacturing defects and thus not defects that occur during or after a change in the product's function and appearance. Your order confirmation is valid as proof of warranty.

9.2 We use the same printing machines, paper types and work processes as our printing partners to minimize color variations. That being said, printing is a chemical process and 100% consistency cannot be achieved. There are several factors that affect the color, texture and final result: machine type, machine settings, paper types, humidity in the room and when the machine was last cleaned, to name just a few examples. Color variations that may occur due to the above mentioned reasons are within acceptable tolerance levels and are not covered by our quality guarantee.


9.3 The right to complain covers goods that are faulty according to current consumer protection legislation. That is, if you received a defective or damaged product or a lack of quality in the delivered product. If you want to place a new order, we will cover the costs of the new order. A customer who wishes to claim an error in an ordered item must contact David Thornell as soon as possible after the error is discovered via the contact details provided on the website. Complaints made within two months from the time you discovered the error are always considered to have been submitted in time. You have a 3-year right to complain about goods purchased on the website.

9.4 David Thornell is responsible for the return shipping for approved complaints.


9.5 Once the claimed item has been returned and the claim approved, David Thornell will compensate you in accordance with current consumer protection legislation. David Thornell strives for this to take place within 14 days of David Thornell receiving the complaint, but it may take longer depending on the nature of the goods. David Thornell reserves the right to refuse a complaint if it turns out that the product is not faulty according to current consumer protection legislation. In the case of complaints, David Thornell follows guidelines from
Allmänna Reklamationsnämnden. More information is available at www.konsumentverket.se.

 

10. LINKS


10.1 David Thornell may link to other websites outside David Thornell's control, and websites outside David Thornell's control may link to the Website. Although David Thornell endeavors to ensure that David Thornell only links to websites that share David Thornell's privacy and security practices as set out in the Privacy Policy, David Thornell is not responsible for the protection or privacy of any information or personal data you provide on other websites. You should exercise caution and read the privacy policy of the website in question.

 

11. FORCE MAJEURE

11.1 David Thornell is not responsible for delays caused by circumstances beyond David Thornell's control, such as general labor disputes, extreme weather conditions, war, fire, lightning, terrorist attack, changes in government regulation, technical problems, electrical/telecommunications/data connection failures or other communication and failure or delay in services from subcontractor due to circumstance specified here. These circumstances shall constitute a basis for exemption which entails exemption from damages and other penalties. If any such situation should arise, David Thornell will inform you partly at the beginning and partly at the end of the time for the current situation. If the circumstance has lasted longer than two months, both you and David Thornell have the right to cancel the purchase with immediate effect.
 

12. CHANGES OF TERMS AND CONDITIONS

12.1 David Thornell reserves the right to make changes to these terms and conditions at any time. Any changes to these terms and conditions will be posted on the website. Changes apply from the time you have accepted the terms (in connection with a new purchase or when visiting the website), alternatively 30 days after David Thornell has informed you of the changes. However, David Thornell recommends that you keep up to date with the website regularly to be aware of any changes to the Terms.

13. INVALIDITY
 

13.1 If a competent court, authority or arbitration panel should find that any provision of these terms and conditions is invalid or unenforceable, the provision in question and all other provisions shall be valid and enforceable to the extent permitted by applicable law. The provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.

 

14. LAW AND DISPUTE

14.1 Disputes shall primarily be resolved amicably after discussion with David Thornell's customer service.


14.2 If the dispute cannot be resolved in agreement with David Thornell's customer service, you as a customer can turn to ARN (Allmänna reklamentationsnämnden), which you can find more information about at www.arn.se. You can also submit complaints directly online via the European Commission's platform for mediation in disputes, which you can find via the following link http://ec.europa.eu/consumers/odr. If you submit a complaint via this platform, your case is automatically forwarded to the appropriate nationally responsible dispute resolution body. This dispute resolution body then contacts us and tries to resolve the dispute without court involvement. In the event of a dispute, David Thornell follows the decision of ARN or the equivalent dispute resolution body.


14.3 Disputes concerning the interpretation or application of these terms and conditions shall be interpreted in accordance with Swedish law and settled in accordance with point 14.2 above or in the last instance by a general court.
